Terms of Service

1. Acceptance of Terms

By accessing or using Anansio ("the Service"), operated by Knoa Tech Labs ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including trial accounts, paying subscribers, and API integrations.

2. Description of Service

Anansio is a B2B prospecting platform that helps businesses discover companies, unlock verified contact information, and send outreach campaigns. The Service includes:

  • Company discovery and search
  • Contact unlocking using a credit-based system
  • AI-assisted message drafting
  • Outreach campaign sending via Amazon Web Services Simple Email Service (AWS SES) or connected Gmail accounts
  • Lead list management and HubSpot CRM export

3. Accounts and Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately at support@anansio.com if you suspect unauthorized access.

You must be at least 18 years old and have the legal authority to enter into a binding agreement to use this Service. Accounts may not be transferred or shared with others without our written consent.

4. Subscriptions, Credits, and Billing

Access to paid features requires an active subscription or a credit balance. Subscriptions are billed on a monthly or annual basis. Credits are used to unlock company contact information and are consumed at the time of unlock.

  • No refunds on credits: Credits consumed for contact unlocks are non-refundable.
  • Subscription cancellation: You may cancel at any time. Cancellation takes effect at the end of the current billing period.
  • Unused credits: Monthly subscription credits that are unused do not roll over to the next billing period. Purchased credit packs do not expire.
  • Price changes: We reserve the right to change pricing with 30 days notice. Continued use after notice constitutes acceptance of the new price.

5. Acceptable Use Policy

You agree to use the Service only for lawful, legitimate B2B prospecting purposes. You must not use the Service to:

  • Send unsolicited bulk email (spam)
  • Harass, threaten, or intimidate individuals
  • Contact individuals who have opted out or unsubscribed
  • Impersonate another person or organization
  • Scrape, copy, or resell data obtained through the Service
  • Circumvent rate limits, security controls, or API restrictions
  • Use the Service for consumer-targeted marketing without proper consent as required by applicable law
  • Violate any applicable local, national, or international law or regulation

We reserve the right to suspend or terminate accounts that violate this policy without notice or refund.

6. Email Sending and CAN-SPAM Compliance

Anansio uses Amazon Web Services Simple Email Service (AWS SES) and optionally connected Gmail accounts to deliver outreach campaigns on your behalf. By using the email sending features, you agree to comply fully with the CAN-SPAM Act (15 U.S.C. § 7704) and any other applicable anti-spam laws, including Canada's Anti-Spam Legislation (CASL) and relevant European regulations.

Your obligations as the sender include:

  • Accurate header information: The "From," "To," "Reply-To," and routing information in your emails must be accurate and identify the person or business who authorized the message.
  • Honest subject lines: Subject lines must not be deceptive or misleading about the content of the message.
  • Physical address disclosure: Every commercial email you send must include your valid physical postal address. You are solely responsible for including this information in your message copy.
  • Opt-out mechanism: Every commercial email you send must include a clear and conspicuous opt-out mechanism. Anansio automatically tracks unsubscribes processed through the platform, but you are responsible for honoring opt-out requests sent directly to you (e.g., reply-based opt-outs) within 10 business days.
  • Prompt unsubscribe processing: Once a contact opts out through Anansio, the platform suppresses that contact from future campaigns. You must not send to suppressed contacts outside the platform.
  • Commercial message identification: Messages sent for commercial purposes must be identified as advertisements where required by applicable law.

You, as the sender, bear sole legal responsibility for compliance with anti-spam laws. Anansio acts as a technical service provider and is not the sender of record. Violations of anti-spam law that result in penalties, fines, or legal action against Anansio or its infrastructure (including AWS SES sending reputation) will result in immediate account termination. You agree to indemnify and hold harmless Knoa Tech Labs for any costs, damages, or penalties arising from your non-compliant use of the email sending features.

7. GDPR and International Data Transfer Compliance

If you are using Anansio to contact individuals located in the European Economic Area (EEA), the United Kingdom, or other jurisdictions with data protection laws, you are responsible for ensuring that your use of the Service complies with those laws, including the General Data Protection Regulation (GDPR) (EU) 2016/679.

Specifically, you agree to:

  • Lawful basis for processing: Identify and rely on a valid lawful basis (such as legitimate interest for B2B prospecting, or consent) before processing personal data of EEA individuals.
  • Transparency: Provide recipients with information about how you obtained their contact information and how you process their data, as required by GDPR Articles 13 and 14.
  • Data subject rights: Honor requests from individuals to access, correct, delete, or restrict processing of their personal data within the timeframes required by applicable law.
  • Data minimization: Only use contact data you unlock through Anansio for the stated prospecting purpose. Do not re-purpose or resell the data.
  • Retention limits: Do not retain unlocked contact data longer than necessary for your outreach purpose.

Anansio processes data located in the United States and Canada. By using the Service, you acknowledge that contact data you access through Anansio may be transferred internationally. You are responsible for ensuring any such transfer is lawful under applicable data protection law.

8. Data Handling

Our collection and use of data is governed by our Privacy Policy and Data Protection page.

Contact data unlocked through the Service is licensed to you for legitimate B2B outreach only. You may not:

  • Resell or redistribute contact data to third parties
  • Use contact data to build competing data products
  • Store or process contact data in ways that violate applicable privacy law
  • Contact individuals who have submitted removal requests to Anansio

9. Intellectual Property

All trademarks, service marks, logos, and the Anansio platform itself are owned by or licensed to Knoa Tech Labs. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You retain ownership of content you create using the Service, such as your campaign copy, lead lists, and account data.

10. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or that results obtained through the Service will be accurate or reliable.

To the fullest extent permitted by law, Knoa Tech Labs shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from your non-compliant use of email sending features
  • Penalties, fines, or legal liability imposed by regulators or courts due to your use of the Service

Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ends immediately. Sections 6, 7, 9, and 10 of these Terms survive termination.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in Ontario, Canada, unless otherwise required by applicable consumer protection law in your jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by emailing the address associated with your account or by posting a notice on the Service. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
